About Domestic Violence  

1.What is domestic violence?
Domestic violence is any violence that occurs between family members.

In families which “Domestic Violence” occurs, Sometimes the violent person is not just the husband. Sometimes it also includes other family members living with you.

2.Who is my family?
Your family in Taiwan could include:
Your husband.
Your mother in law/father in law.
Your husbands grandparents, your children, foster children, husbands children with former wife.
Your husbands brothers, sisters, uncles, aunts, cousins, nephews, nieces, etc.


 
3.What you can do to reduce the occurrence of domestic violence?
  1. In ordinary situations, discuss things in a complete, unrushed manner, using a gentle tone of voice, Practice using affirming language when communication with the other. If you feel that the other is wrong, don’t simply say “you’re wrong”. Instead, you can discuss it later at a more appropriate time.
  2. If you are having serious arguments with family members, you can:
    (a) Calm down and leave the situation
    (b) Change the topic
    (c) Be weary of violent signs: if the family member suddenly rushes over with exaggerated tone of voice or action, starts to look for a belt, stick, knife, etc.
    (d) Don’t argue in narrow, small spaces such as the kitchen or bathroom, or in places with many dangerous items. Try to look for a safer environment first.
    (e) First send the kids to their rooms, so they may avoid harm in case of a violent episode.
If your husband or other family member has a history of violence against you, them you should carry your passport, important ID info (such as ARC), and some money with at all times. In addition, you should leave several changes of clothes and copies of the above ID information at a friend’s home so that quick escape can be made. You should memorize the telephone number of your friends, domestic abuse prevention center, and other related governmental institutions just in case.


 
4.What to do in the event of domestic violence?
  1. Stay calm: Don’t say anything rash. At the same time, find a chance to leave the area, and go to a neighbor of friend’s house.
  2. Protect yourself: Especially your head, face, neck, chest, and stomach.
  3. Call for help: Ask family members or neighbors to help stop the attack.
  4. When you seek medical attention, you should ask the physician to examine your wounds, collect an exam report, and have pictures taken of the wounds.
  5. Report the event to the police. The police will fill out a “domestic abuse investigation form “, and file various pieces of evidence: such as injury report, handwritten account, damaged clothing, and weapon used. If you would like to apply for a restraining order, you must notice the police.
What is a “restraining order”?

Defined by regulations in “Domestic Abuse prevention Law”, a “restraining order” is a court authorized order that can restrain the actions of violent persons, and guarantees the rights and safety of the victim. A “restraining order” can not only protect you, it can also help you to apply for temporary custody of your children, and require that your husband return your ID.

*In addition, you can also make records of the abuse, including: voice recording, photos, etc. you can take pictures of broken furniture or damages in the site of a violent attack. You should keep any evidence that can prove that you have been abuse d by family members. For example: instruments used by the family member during the attack, injury reports, etc. at the same time, you can also look for a witness who can testify for you.


 
5.Who to look for help?
Police institutions
110 Report hotline
Pick up the phone and dial 110. Tell the police officers what happened, and remember to report your home address. When the police receive your call for help, they will immediately notify the nearest police dispatch station to your house, and have a police office immediately rush to your assistance. They will also make a recording of the report process, which can be also used as proof.

Police stations
In every city and country, there is a “domestic abuse prevention officer” stationed in every police station. This office is specifically employed to assist you in the application for a restraining order and other related safety matters. If you are involved in domestic abuse, you can report it directly to the police station.
  • If you are not willing to sue your husband or family members, the police will make a notation in the “police log”.
  • If you want to file a lawsuit, the police will help you make a written log, and begin the processing. If you are injured, the police can also take you to the emergence ward.
  • When the police arrive at the scene of the attack, they will determine whether or not an “emergency restraining order” is necessary. In addition, they will take you away from the scene and separate you from the abusing party. If you require emergency lodging, the officer processing your case will immediately notify the Domestic Violence and Sexual Abuse Prevention Center (to be referred to a Prevention Center). The social worker will help you find accommodations.
  • If the report is made during night hour or the social workers are off duty, they will take you and your children (if your children are also victims of abuse) to a hotel or female police precinct. On the following day, the female precinct shall notify the Prevention Center, and help relocate you to safe house.
  • If your important ID information is at home, you can request an officer to escort your home to pick it up.
  • If your ID has been confiscated or your VISA is about to expire, you can ask for assistance with a police station. Due to the different processing systems for residents of mainland China and other countries we have made a reference chart for your convenience.

Your VISA is about to expire. You should apply for an extension with the Foreign Affairs Department within 15 days of expiration, as required by immigration law. This way you can avoid being deported because of an expired VISA.
